1. About Us
This website is operated by Merchable Ltd, a company registered in England and Wales, trading as Merchable. These Terms & Conditions govern your use of merchable.co.uk and any services, quotes, or orders arranged through it. By engaging our services or using this site, you agree to be bound by these terms.
2. Our Services
Merchable provides branded merchandise consultancy services, including creative direction, sourcing, design, production, and logistics, for both print-on-demand items and bulk production orders. Specific scope, pricing, and timelines for each project are confirmed in writing (quote, invoice, or order confirmation) before work begins.
3. Quotes and Pricing
All quotes are valid for 14 days from the date issued unless otherwise stated. Prices are subject to change based on final specifications, quantities, and material costs. We will confirm final pricing in writing before production begins.
4. Payment Terms
Bulk production orders typically require a deposit before work commences, with the balance due prior to shipment unless otherwise agreed in writing. Deposits are non-refundable once production has started (see our Refund Policy for full details). Late payment may result in delays to production or delivery.
5. Approvals and Samples
Where physical or digital samples/proofs are provided, the customer is responsible for reviewing and approving them before full production begins. Once a proof is approved, Merchable is not liable for errors that were present in and unflagged on the approved proof.
6. Delivery
Delivery timescales are estimates and not guaranteed unless explicitly agreed in writing. Merchable is not responsible for delays caused by third-party couriers, customs, or circumstances outside our reasonable control.
7. Cancellations and Refunds
Cancellations, refunds, and returns are governed by our separate Refund Policy, which forms part of these Terms.
8. Intellectual Property
Any designs, artwork, or creative work produced by Merchable remain our intellectual property until full payment is received, at which point rights transfer to the customer as agreed in the relevant project scope, unless otherwise specified in writing. Customers warrant that any logos, artwork, or brand assets they supply do not infringe third-party rights.
9. Limitation of Liability
To the fullest extent permitted by law, Merchable's liability for any claim arising from services provided is limited to the value of the relevant order. We are not liable for indirect or consequential losses.
10. Confidentiality
Both parties agree to keep confidential any non-public business information shared during the course of a project.
11. Governing Law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
